TAKE NOTICE that the Council of the Corporation of the Town of Espanola passed Bylaw No. 2798/17 on the 11th day of July 2017, under Section 34(18) of the Planning Act.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the Zoning Bylaw Amendment, by filing with the Clerk of the Corporation of the Town of Espanola not later than the 9th day of August, 2017, a Notice of Appeal setting out the objection to the Zoning Bylaw Amendment and the reasons in support of the objection. A Notice of Appeal must include the prescribed fee of $125.00 (certified cheque or money order) made payable to the Minister of Finance.

AND TAKE NOTICE that only individuals, corporations and public bodies may appeal the Zoning Bylaw Amendment to the Ontario Municipal Board.  A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the Zoning Bylaw Amendment was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

The purpose of this Zoning Bylaw Amendment is to rezone the affected property from the Highway Commercial (C2) to the Residential First Density – Special Exception Eleven (R1 - 14) in order to Zone the property for Residential use only with no Commercial use permitted.  The Bylaw also recognizes existing reduced yard setbacks.

A copy of the complete Zoning Bylaw Amendment including an explanation of the purpose and effect of the Bylaw, describing the affected property and the Key Map is available for inspection during regular office hours at the Municipal Office, 100 Tudhope Street, Suite 2, Espanola.
